• Juridical Guidance and Representation: Provide legal guidance and represent the municipality in administrative enforcement cases related to environmental law and special legislation.
• Regulatory Compliance: Assess compliance with laws and regulations to determine if violations have occurred.
• Documentation: Draft complex tolerance decisions, warning letters, preliminary notices, emergency administrative enforcement orders, orders subject to enforcement, and collection decisions.
• Handling Objections: Manage both written and oral objections.
• Legal Representation: Independently represent the municipality in legal proceedings before the external committee for objections and appeals, the court, and the Administrative Jurisdiction Division of the Council of State.
• Collaboration: Consult with enforcement agencies and chain partners.
• Regulatory Alignment: Ensure alignment of municipal regulations (policy) and ordinances.
• Policy Input: Contribute to the development of municipal policy and zoning plans regarding their enforceability.
• Legal Expertise: Serve as a legal resource within the department on enforcement matters.
• Advisory Role: Act as a legal advisor for building and housing inspectors and public space supervisors.
• Mediation: Participate as a discussion partner in informal mediation processes following objections.
• Informative Notes: Prepare informative notes for the executive and the council.
• Support: Assist in the implementation, interpretation, and application of complex laws and regulations, and in drafting complex legal correspondence and decisions.
• Peer Review: Conduct collegial (reading) reviews.

Gevraagd

Eisen:

1. De aangeboden kandidaat heeft in de afgelopen 6 maanden niet 3 overeenkomsten met een totale duur van 24 maanden gehad bij de opdrachtgever. (Dit criterium is niet van toepassing op kandidaten die een vast dienstverband hebben bij de uitlenende partij.)
2. Een afgeronde opleiding op minimaal WO niveau
3. Minimaal 5 jaar aantoonbare werkervaring als senior jurist handhaving met name op het gebied van Omgevingsrecht en op het gebied van Openbare Orde en Veiligheid
4. Minimaal 3 jaar werkervaring bij een grote gemeente (van minimaal 100.000 inwoners).

Wensen:

• Minimaal 5 jaar aantoonbare werkervaring in de afgelopen 10 jaar als jurist op het gebied handhaving op het gebied van Omgevingsrecht en Openbare Orde en Veiligheid binnen een overheidsorganisatie
• Aantoonbare werkervaring in de afgelopen 6 jaar met Powerbrowser
• Minimaal 1 jaar aantoonbare werkervaring in de afgelopen 5 jaar als jurist op het gebied handhaving op het gebied van Omgevingsrecht en Openbare Orde en Veiligheid binnen een gemeente

Waar je gaat werken

• De meeste functies zijn tijdelijke functies voor een langere periode. Soms met uitzicht op vast.
• ZZP is niet altijd mogelijk.
• Goede beheersing van het Nederlands is voor alle functies vereist
• Ervaring bij een overheidsorganisatie is een grote pré, soms een eis.
